Financial Regulatory Environment in Germany
At ABM Global Compliance, we help financial services businesses understand this regulatory environment, determine how relevant requirements affect their activities and develop appropriate compliance frameworks for entering and operating within the German market. For banking institutions within the European Banking Union, the European Central Bank (ECB) has additional responsibilities under the Single Supervisory Mechanism (SSM).
Understanding Germany’s Financial Services Regulatory & Compliance Framework
Germany is one of Europe’s largest and most sophisticated financial markets, with an extensive regulatory framework covering banking, payment and e-money services, cryptoassets, securities, investment services and other regulated financial activities. As a member of the European Union and Eurozone, Germany combines national financial legislation with directly applicable and implemented EU regulatory requirements.
The regulatory route for a business depends on the nature of its activities, products, services and institutional structure. At ABM Global Compliance, we help financial services businesses understand this regulatory environment, determine how relevant requirements affect their activities and develop appropriate compliance frameworks for entering and operating within the German market.
Our Compliance Services in Germany
Different laws and regulatory regimes apply depending on the activities undertaken. For example, the German Banking Act (Kreditwesengesetz, KWG) remains an important legal basis for banking and relevant financial services supervision, while payment institutions and electronic money institutions are supervised under the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG).

Your Questions Answered
Who regulates financial services in Germany?
BaFin supervises banks, payment and e-money institutions, investment firms, and cryptoasset providers, working with the Deutsche Bundesbank on banking supervision, while the ECB supervises significant banks directly.
Do EU licences work in Germany automatically?
Not automatically. EU-authorised firms can passport into Germany, but notifications through home and host regulators must complete first, and some conduct and AML obligations still apply locally.
What licences do Money Services Businesses need?
Payment services and e-money issuance require BaFin authorisation under the Payment Services Supervision Act (ZAG); currency exchange and related activities carry separate requirements under the Banking Act.
How strict is German AML supervision?
Demanding and increasing. The Money Laundering Act (GwG) sets detailed obligations, BaFin examines controls actively with the FIU handling reports, and the EU AML Regulation will raise expectations further.
Can ABM Global Compliance support market entry?
Yes. We advise across the full entry journey: licensing strategy, governance and policies, AML/CFT programmes, and ongoing compliance, while your business remains the regulated operator.
